Trial Begins For Illegal Immigrant Charged In Crash That Killed 7 Year-Old

The trial for an illegal immigrant, accused of striking and killing a 7 year-old boy, trying to cross the roadway in front of his grandmother’s home last year, began Monday in Johnston County Superior Court. 

 

 Hipolito Hernandez, 31, of Parkertown Road, Four Oaks is charged with second-degree murder, felony hit and run, felony assault, driving while impaired, reckless driving, operating a stolen motor vehicle, and driving without a license. Hernandez ran off Heath Road on April 13, 2008 striking Marcus Lassiter of Selma. 

 

The child died the next day at Duke Medical Center after his family made to decision to remove him from life support. Witnesses said Hernandez fled on foot from the crash scene without checking on the condition of the injured child.

 

 Law enforcement officers with the help of a Good Samaritan, Allen Hester, caught him about an hour later. Hernandez had been charged with DWI four times before the fatal crash last year. Two were dropped, one was pled down to a lesser offense, and the fourth charge was pending in court.

 

Attorney Lee Hatch, according to WRAL, handled both the two DWI cases dismissed against the illegal immigrant.  The prosecutor in one of the cases was Cindy Jaeger.  They are among six people charged in a ticket-fixing scheme, although the two cases against Hernandez were not part of an SBI investigation that led to their arrests in March.
